Getting Monongalia County Court Records
The route depends on the court. Use WVPASS to orient a circuit search and MCR for a magistrate index. MCR does not supply document images. Circuit Clerk Donna Hidock handles circuit and family files; Magistrate Clerk Kandy McCauley handles magistrate documents. Requests may proceed in person, by mail, or after a phone call confirms current instructions.
- Identify the court, full case number, party names, date range, and precise document.
- Check WVPASS for circuit indexing or MCR for magistrate cases.
- Call 304-291-7240 for circuit or family records, or 304-291-7296 for magistrate records.
- Inspect the open file at the correct clerk counter, or ask how to send a focused mail request.
- State the preferred format and whether an ordinary, attested, or certified copy is required.
- For a West Virginia FOIA request, describe an existing record and preserve the response.
No Monongalia-specific email form or universal copy cart was located. Phone contact helps prepare a request, but staff need not read or summarize a file aloud. The Circuit Clerk Manual permits straightforward questions about open setting, charge, or complaint-type information.
For inspection, the circuit and magistrate offices are at the Monongalia County Justice Center, 75 High Street, Morgantown, WV 26505. The Circuit Clerk is in Suite 12 and the Magistrate Clerk is in Suite 25. Open files may be viewed during reasonable business hours under clerk supervision, and files may not leave the office.
Four Monongalia County Court Record Layers
A search result, docket, document, and certified copy are related but distinct. The result identifies a case. The docket orders activity by date. The file holds complaints, motions, orders, judgments, and exhibits. A certified copy reproduces an item with clerk authentication.
Index: a basic case listing.
Docket: the register of filings and events.
Document: the paper behind an entry.
Certification: clerk comparison, signature, and seal.
This difference matters in MCR, which shows case and docket detail but not the magistrate documents. Name the paper needed rather than asking for everything in a search result.
A public index may remain useful when the file is restricted. Family rules make orders and indices public while keeping most pleadings, recordings, exhibits, transcripts, and documents confidential. The visible layer does not open the hidden layer. State the precise item sought and let the clerk apply the governing access rule.
Monongalia County Court Record Types
Monongalia County courts create several file types, and access may differ within one matter. Common categories include:
- Civil complaints, answers, motions, judgments, and appeal papers.
- Criminal complaints, indictments, bond entries, orders, and judgments.
- Magistrate citation, charge, event, party, bond, and docket records.
- Family indices and orders, with most underlying material confidential.
- Docket sheets and ordinary, attested, or certified copies.
Deeds, liens, estates, UCC filings, and vital records belong to the separate County Clerk system at 243 High Street. Its “Minutes & Orders” category is not proof of a circuit filing. Municipal and federal records also remain separate.
CourtPLUS and Monongalia County Court Records
Monongalia joined statewide circuit and family e-filing on July 15, 2024. CourtPLUS manages cases, WV E-File serves registered filing users, and Vault stores digital documents. An e-filing sign-in is not a public docket search.
The 2026 Judiciary FAQ says paper documents are scanned by the Circuit Clerk. Pro se matters can still involve paper, sealed documents are paper-filed, and public access remains at the clerk. It also states a 10 MB limit per uploaded document and describes correction letters to the clerk or judge.
The official CourtPLUS overview documents this filing layer.

Inspection and copy questions still go to the Circuit Clerk even when the filing began electronically.
Inside a Monongalia County Court Record
Read the file as a sequence. The number identifies it, the docket orders activity, and each document supplies substance behind a short entry.
| Case Number | A routing key; examples include 19-F-###, while local systems may show longer prefixes. |
|---|---|
| Pleadings | Complaints, petitions, answers, and motions. |
| Orders & Judgments | Signed interim or final court rulings. |
| Docket Sheet | The dated list of filings, settings, service, and actions. |
| Events | Date, time, room, judge, event type, and possible closure reason. |
| Exhibits | Filed evidence or attachments, subject to access rules. |
A code must be read with its description and date. A warrant entry is not guilt, and a bond entry is not disposition. For consequential use, obtain the signed order or certified record.
MCR details may also include related cases, party roles, individual charges, non-monetary sentences, civil judgments, and bond data. A bond amount must be read with status, posted total, payor, and later release or refund entries. One field rarely tells the full procedural story.
Fees and Certified Copies
An ordinary copy reproduces a record. An attested copy has clerk authentication, while a certified copy is compared with the original and carries the required signature and seal. Tell the clerk what the receiving court, agency, or proceeding requires. A screen print and certification are not interchangeable.
| Item | Amount |
|---|---|
| Circuit copy or transcript for use outside the office | $1 per page under W. Va. Code §59-1-11 |
| Abstract of judgment | $5 under the statutory schedule |
| Magistrate document copy | Nominal fee; exact local amount was not published |
| Certification and other services | Confirm the current total with the responsible clerk |

Choosing the Right Monongalia County Copy
Ask the receiving authority before ordering. A reader who only needs to understand a filed order may need a plain copy. A court filing, official registration, or formal proof may require certification. The clerk cannot decide the legal sufficiency of a copy for another process.
For a large request, list the docket dates and document titles rather than asking staff to compile a new report. West Virginia FOIA allows inspection and copies of existing public records and permits actual reproduction costs. It does not require the custodian to create a summary. Confirm the estimate and delivery method before paying.
Sealed Records and Public Access
Open court papers may be inspected during usual business hours, but family, juvenile, sealed, and confidential material follows special rules. A missing portal document is not proof of sealing. It may be paper-only, excluded from the system, or available solely through the clerk. Ask what public portion exists.
Key Rules:
West Virginia Code §51-4-2 makes court records open to inspection and directs the clerk to furnish copies, subject to limits.
West Virginia FOIA §29B-1-3 provides inspection and copying rights and a response period of five days excluding weekends and legal holidays.
West Virginia Code §49-5-103 protects juvenile court records and limits disclosure.
Family Rule 6 makes orders and indices public but keeps most pleadings, recordings, exhibits, transcripts, and documents confidential. Trial Court Rules 10.03 and 15A.23 govern access limits and sealed filings. A contested request to open sealed material requires the court's process, not a clerk's informal decision.
West Virginia FOIA permits a request for electronic form and generally requires a response within five days excluding weekends and legal holidays. It permits actual reproduction costs, not a search or staff-hour charge merely to locate records. Court-specific rules work alongside those principles, so send the request to the custodian of the actual file.
Protected Data in Monongalia County Court Files
Trial Court Rule 15A.24 places redaction duties on filers for full Social Security numbers, taxpayer identifiers, license and passport numbers, financial account numbers, PINs, and passwords. That rule does not guarantee that every older document has perfect redactions.
If protected data appears in a public Monongalia County record, do not copy or redistribute it. Note the document and page, then contact the clerk or court about the correction or restriction process. The Special Access Portal terms also identify victim, informant, juror, witness, unserved-warrant, and personal-security information as protected categories.
County Clerk Records Are a Separate Monongalia Trail
The Monongalia County Clerk at Courthouse Room 123 keeps recording, probate, election, vital, and related county records. Its online search offers deeds, liens, estates, UCC, marriage and vital categories, export tools, and “Minutes & Orders.” Those features can add context but do not replace a Circuit Clerk court record.
The County Clerk posts separate copy charges, including $1.50 for the first two pages and $1 for each added page for certain county records, plus $2.50 for certified or electronic copies. Do not apply that schedule to circuit or magistrate files. First identify the custodian, then use that office's current fee rules.
